Terms of Service

Also see our Privacy Policy.
1. Who we are
These Terms of Service ("Terms") govern your access to and use of the Vestosia website, web application at vestosia.com, and mobile apps (the "Service"), operated by Vestosia ("Vestosia", "we", "us", or "our"), based in the United Kingdom.
Questions about these Terms: [email protected]. General support: [email protected].
2. Agreeing to these Terms
By creating an account, signing in, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, you must not use the Service.
If you use the Service on behalf of an organisation, you confirm that you have authority to bind that organisation to these Terms.
3. The Service
Vestosia is a free-to-use platform for discovering, playing, creating, and sharing browser-based games. Features may include (depending on what is available to you at the time):
- a game discovery feed and playback of HTML games;
- accounts, profiles, follows, likes, comments, and related social features;
- creator tools to upload and publish games;
- AI-assisted creation tools ("Vibecoding") that help generate or revise game content;
- search, challenges, notifications, reporting, and moderation features.
We may change, suspend, or discontinue any part of the Service, temporarily or permanently, where reasonably necessary (for example for maintenance, security, legal compliance, or product evolution). Where a change is material and adversely affects your use of the Service, we will take reasonable steps to notify you.
4. Eligibility and accounts
4.1 Age
You must be at least 13 years old to use Vestosia. If you are under 18 (or under the age of legal majority where you live), you may only use the Service with the consent of a parent or legal guardian, who must also agree to these Terms on your behalf.
4.2 Account registration
To access certain features you must create an account using an email address and password, or sign in with Google. You must provide accurate information and keep it up to date. You must not impersonate another person or use an account that does not belong to you.
4.3 Account security
You are responsible for keeping your login credentials confidential and for activity under your account. Use a strong password and tell us promptly at [email protected] if you suspect unauthorised access.
4.4 Suspension and termination
We may suspend or terminate your account, or restrict access to features, if we reasonably believe you have breached these Terms, created risk or possible legal exposure for us or others, or engaged in fraud, abuse, or harmful conduct. We may also terminate accounts that are inactive for a prolonged period. Where practicable, we will notify you of suspension or termination and the reason.
You may delete your account at any time through Settings. Deletion removes your ability to use the Service under that account; residual copies may remain in backups for a limited period as described in our Privacy Policy.
5. Acceptable use
You agree not to:
- upload, publish, or transmit content that is illegal, defamatory, harassing, hateful, pornographic, exploitative of minors, or that promotes violence or serious harm;
- infringe anyone else's intellectual property, privacy, or other rights;
- upload malware, malicious scripts, or games designed to exploit players, steal data, or break out of the intended sandbox;
- scrape, harvest, or bulk-download the Service or other users' content without our prior written permission, except as allowed by ordinary browser use;
- attempt to probe, scan, or breach our systems or security, or circumvent rate limits or technical protections;
- abuse AI tools (including attempting to extract system prompts, generate prohibited content, or overload capacity);
- spam, manipulate engagement metrics, or interfere with other users' enjoyment of the Service;
- use the Service for any unlawful purpose or in breach of applicable law.
We may remove content, limit features, or take account action if we reasonably believe these rules have been broken. You can report concerns through in-product reporting tools or by contacting support.
6. User content
6.1 Ownership
You retain ownership of content you create or upload to the Service ("User Content"), including games, code, assets, text, images, comments, and AI prompts you provide, subject to the rights of any third parties and to the licence below.
6.2 Licence to Vestosia
By submitting User Content, you grant Vestosia a non-exclusive, worldwide, royalty-free, transferable, and sublicensable licence to host, store, reproduce, modify (for formatting, moderation, or technical delivery), display, perform, distribute, and otherwise use that User Content solely as needed to operate, improve, secure, and promote the Service. This licence ends when you delete the content or your account, except that we may retain copies for a reasonable period for backups, legal compliance, dispute resolution, or security, and residual copies in caches or previously published materials may persist briefly until refreshed.
6.3 Your warranties
You confirm that you have all rights needed to submit User Content and to grant the licence above, and that your User Content does not violate these Terms or applicable law.
6.4 Moderation
We may review, refuse, remove, or restrict User Content that we reasonably believe breaches these Terms or creates risk for users or the Service. We do not undertake to review all content and are not responsible for User Content posted by others.
7. AI generation (Vibecoding)
Vibecoding uses third-party AI services (including Google Gemini) to help generate or revise game-related content from your prompts and inputs.
- Your inputs: You are responsible for prompts, images, and other inputs you provide, and for ensuring you have the right to use them.
- Outputs: AI outputs may be inaccurate, incomplete, unsafe to run without review, or similar to outputs generated for others. We do not warrant that outputs are unique, non-infringing, fit for purpose, or free from defects. You must review outputs before publishing or relying on them.
- Processing: Inputs and related generation data may be processed by our AI providers to deliver the feature, as further described in our Privacy Policy.
- Limits: We may apply rate limits and suspend access for abuse, reverse-engineering of system instructions, or excessive load.
8. Vestosia intellectual property
The Service (excluding User Content), including software, design, branding, logos, and documentation, is owned by Vestosia or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works from our materials except as expressly allowed by these Terms or with our prior written consent.
9. Copyright and intellectual property complaints
If you believe content on the Service infringes your copyright or other intellectual property rights, please send a notice to [email protected] including:
- your name and contact details;
- a description of the work you claim is infringed;
- the URL or location of the allegedly infringing material;
- a statement that you believe in good faith that the use is not authorised; and
- a statement that the information in your notice is accurate and that you are the rights holder or authorised to act for them.
We may remove or disable access to material that we reasonably believe infringes rights, and may terminate repeat infringers where appropriate. If you are a US rights holder and wish to send a notice in the style of 17 U.S.C. § 512, you may include the additional statutory elements required under that law in your email to the same address; we will consider such notices in good faith.
10. Arcade Tickets
Arcade Tickets ("Tickets") are a virtual currency used on the Service for in-game purchases, creator tips, and related features. Tickets have no cash value, are not redeemable for money, and do not entitle you to a cash-out or withdrawal.
Ticket purchases are non-refundable, except where required by applicable law. Once Tickets are credited to your account, they are considered used virtual currency. If a payment provider force-reverses a charge (for example a chargeback), we may deduct any remaining Ticket balance associated with that purchase; Tickets already spent and any related in-game entitlements or creator credits are not automatically unwound.
11. Disclaimer
The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties that are not express in these Terms, including implied warranties of satisfactory quality, fitness for a particular purpose, and non-infringement.
We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that games or AI outputs will work as expected on every device or browser.
Nothing in these Terms excludes or limits any rights you have as a consumer under the Consumer Rights Act 2015 or other applicable UK consumer law that cannot be excluded or limited by contract.
12. Limitation of liability
Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited under applicable law.
Subject to the paragraph above, we are not liable for: loss of profits, revenue, business, goodwill, or anticipated savings; loss or corruption of data; or any indirect or consequential loss, whether arising in contract, tort (including negligence), or otherwise, even if foreseeable.
Subject to the paragraphs above, our total aggregate liability to you arising out of or in connection with the Service or these Terms is limited to £100 (one hundred pounds sterling).
13. Indemnity
You agree to indemnify and hold harmless Vestosia from and against reasonable losses, damages, and expenses (including reasonable legal fees) arising from your breach of these Terms, your User Content, or your unlawful use of the Service, except to the extent caused by our negligence or breach of these Terms.
14. Events beyond our control
We are not liable for any failure or delay in performing our obligations where that failure or delay results from events beyond our reasonable control, including natural disasters, war, terrorism, riots, embargos, acts of civil or military authorities, fire, floods, accidents, network or utility failures, strikes, or shortages of transport, facilities, fuel, energy, labour, or materials.
15. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page shows when they were last revised. For material changes, we will take reasonable steps to notify you (for example by email or an in-Service notice) before the changes take effect. If you continue to use the Service after the effective date of updated Terms, you accept the updated Terms. If you do not agree, you should stop using the Service and may delete your account.
16. Governing law and disputes
These Terms and any dispute or claim arising out of or in connection with them or the Service are governed by the laws of England and Wales.
The courts of England and Wales have exclusive jurisdiction, except that if you are a consumer resident in the UK, you may also bring proceedings in the courts of the part of the UK where you live. We encourage you to contact us first so we can try to resolve concerns informally.
If you are a consumer, you may also be entitled to use alternative dispute resolution schemes available in your area; nothing in these Terms affects that right.
17. General
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions continue in full force. Our failure to enforce a provision is not a waiver of our right to do so later. You may not assign your rights under these Terms without our prior written consent; we may assign them in connection with a reorganisation or transfer of the Service. These Terms, together with the Privacy Policy and any feature-specific notices we present to you, form the entire agreement between you and us regarding the Service.
